The Employer Nomination Scheme (ENS) visa lets skilled workers, who are nominated by an employer, live and work in Australia permanently. Generally, the Employer Nomination Scheme (ENS) visa has three (3) streams, which are:
- Direct Entry stream (‘DE‘)
- Temporary Residence Transition stream (‘TRT‘)
- Labour Agreement stream
Basic Eligibility (DE)
Firstly, the sponsor will need to:
- show it is a business operating lawfully
- offer a skilled position that is full-time and ongoing for at least two years
- pay the Skilling Australians Fund (SAF)
- sponsor’s annual turnover of less than $10M – $3,000 one-off
- sponsor’s annual turnover of $10M or more – $5,000 one-off
- Medium and Long‑term Strategic Skills List (MLTSSL) (section 7 of Instrument LIN 19/049)
- show a ‘Genuine Need‘ for the position
- pay the applicant at least the market rate for the nominated position
Secondly, the applicant will need to:
- be less than 45 years of age when applying unless an age exemption applies
- have at least 3 years relevant work experience in their occupation.
- have a skills assessment that shows they have the skills to work in the nominated position
- show that the applicant holds the licences and registrations necessary to work in the nominated occupation
- show Competent English; no English exemption applies
Basic Eligibility (TRT)
Firstly, the sponsor will need to:
- show it is a business operating lawfully
- offer a skilled position that is full-time and ongoing for at least two years
- pay the Skilling Australians Fund (SAF)
- sponsor’s annual turnover of less than $10M – $3,000 one-off
- sponsor’s annual turnover of $10M or more – $5,000 one-off
- nominate an occupation that is listed in the ANZSCO and be the same ANZSCO 4-digit occupation unit group code as the occupation the 482 visa was granted in relation to.
- show a ‘Genuine Need‘ for the position
- pay the applicant at least the market rate for the nominated position
Secondly, the applicant will need to:
- be less than 45 years of age when applying unless an age exemption applies
- have the required skills and qualifications needed to perform the tasks of the nominated occupation
- have been sponsored by the employer who you worked full-time for on your 482 visa for at least 2 of the 3 years prior to nominating you for the subclass 186 visa
- show that the applicant holds the licences and registrations necessary to work in the nominated occupation
- show Competent English; no English exemption applies
