Unlike previous generations, Australian businesses are now facing a labour supply shortage and the lack of skilled workers being available is a major concern. Therefore, Australian businesses need to expand its way of thinking by looking overseas for skilled workers. The Temporary Skill Shortage visa, also known as the 482 Visa or TSS Visa is the appropriate employer-sponsored work visa.

Despite using overseas workers as a labour supply shortage solution, Australian businesses should still be encouraged to maintain Australian workers as a core part of their labour workforce.

Generally, the TSS visa period varies and will depend on the nominated stream, namely:

• Short-term stream (STSOL) – 2 years
• Medium-term stream (MLTSSL or ROL) – 4 years

Basic Eligibility

Firstly, the sponsor will need to:

• be a business operating lawfully
• pay the Skilling Australians Fund (SAF)
  • sponsor’s annual turnover of less than $10M – $1,200 per year
  • sponsor’s annual turnover of $10M and more – $1,800 per year
• nominate an occupation on the:
  • Short-term Skilled Occupation List (STSOL) (section 6 of Instrument LIN 19/048)
  • Medium and Long-term Strategic Skills List (MLTSSL) (section 7 of Instrument LIN 19/048)
  • Regional Occupation List (ROL) (section 8 of Instrument LIN 19/048)
• if required, satisfy the ‘Caveat‘ requirements
• pay the applicant the annual market salary rate (AMSR) for the nominated occupation

Secondly, the applicant will need to:

• be employed in the nominated occupation
• show that the applicant has the skills, qualifications and at least 2 years of experience in the nominated occupation
• show that the applicant holds the necessary licences and registrations necessary to work in the nominated occupation
• satisfy the English criteria:
  • Short-term stream (STSOL) – Overall band score of at least 5.0 with at least 4.5 in each of the test components
  • Medium-term stream (MLTSSL or ROL) – Overall band score of at least 5.0 with at least 5 in each of the test components.
